Terms of Service

Effective September 4, 2026

1. Who we are and what this agreement covers

AppCut (“AppCut,” “Company,” “we,” “us,” or “our”) operates appcut.ai and app.appcut.ai. These Terms of Service (“Terms”) govern your access to and use of the AppCut website, application, and related services (collectively, the “Service”) at app.appcut.ai. If AppCut is later incorporated as a company, that entity will automatically succeed to the rights and obligations of “Company” under these Terms, and we’ll update this document to name it.

By creating an account or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you don’t agree, don’t use the Service.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Service. The Service is intended for businesses and individuals creating advertising creative for mobile apps and games — it is not directed at children, and you may not use it on behalf of a business you’re not authorized to represent.

3. Accounts

You’re responsible for the accuracy of the information you provide and for safeguarding your login credentials. You’re responsible for all activity that happens under your account, including actions taken by teammates you invite. Notify us at hello@appcut.ai if you suspect unauthorized access.

4. The Service

AppCut helps you generate UGC-style video advertisements for your mobile app or game. A defining part of how the Service works: real app screenshots, gameplay footage, and store assets you provide are never handed to the generative video model and never appear as AI-hallucinated content — they are composited into the finished video using standard video-editing techniques after generation. The AI model (see Section 6) generates only the non-app-footage portions of the video (e.g. a presenter, a scene, on-screen motion graphics).

5. Your content and the license you grant us

“Your Content” means anything you upload or submit to the Service — screenshots, video, logos, store copy, and any other assets — plus any app store URL you provide, which we use to pull publicly available store listing data (name, description, screenshots, icon, category) directly from Google Play or the Apple App Store.

You retain ownership of Your Content. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and modify Your Content solely to provide the Service to you — principally, to generate video output on your behalf. We do not use Your Content to train our own AI models, and we do not sell it. Any reference images or prompts sent to our third-party video-generation vendor (Section 6) are handled under that vendor’s own data-use terms, which govern independently of this agreement.

You represent that you own Your Content or otherwise have the rights necessary to upload it and to have it incorporated into advertising creative, and that it doesn’t infringe any third party’s rights or violate any law. You agree to indemnify and hold us harmless from any claim arising from a breach of this representation.

6. Generated output, and the third-party AI model behind it

The Service uses a third-party generative video model, currently BytePlus’s ModelArk (Seedance), to generate the portions of your video described in Section 4. We don’t control how that model was trained or guarantee the accuracy, appropriateness, or originality of what it generates. Generated video is automatically screened before it’s delivered to you (see Section 7), but that screening is not a guarantee — you are solely responsible for reviewing any generated output before publishing it as an advertisement, including for compliance with the advertising policies of any platform you use (e.g. Meta, TikTok, Google) and for any intellectual property concerns in the AI-generated portions.

Subject to your compliance with these Terms and payment of applicable fees, you own the finished video output generated for your account and may use it for advertising and any other lawful purpose.

7. Content moderation

Before delivery, generated video is automatically reviewed for content that violates these Terms or our internal safety standards. We may decline to deliver, or may remove, output that fails this review. This process is automated and not exhaustive — it does not shift responsibility for the final creative away from you.

8. Acceptable use

You agree not to use the Service to:

  • Generate content that is illegal, fraudulent, deceptive, defamatory, or infringing;
  • Generate advertising for products or services that are illegal or that you’re not authorized to advertise;
  • Upload content you don’t have the rights to, or that impersonates a real person without consent;
  • Circumvent rate limits, credit accounting, or other technical restrictions;
  • Resell or provide the Service to third parties without our written consent;
  • Reverse-engineer, scrape, or attempt to extract the underlying models or source code of the Service.

We may suspend or terminate accounts that violate this section, with or without notice, at our discretion.

9. Subscriptions, billing, and credits

Paid plans are billed as recurring monthly subscriptions and processed by Polar, our payment processor and merchant of record. Your purchase is also subject to Polar’s Buyer Terms. Each plan includes a monthly credit allotment that resets on renewal — unused credits from a prior cycle do not carry over. We don’t control Polar’s payment processing, and refund requests are handled per Polar’s policies and applicable law.

You can manage or cancel your subscription at any time through the billing portal linked from your account. We may change our prices with reasonable advance notice; continued use after a price change takes effect constitutes acceptance.

10. Termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate your access for violation of these Terms, non-payment, or if required by law. If you’re the sole owner of an account, deleting your login deletes the account and its data; if you share an account with other owners, deleting your own login only removes your membership.

11. Disclaimers

THE SERVICE, INCLUDING ALL AI-GENERATED OUTPUT, IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT GENERATED OUTPUT WILL BE ACCURATE, APPROPRIATE, OR COMPLIANT WITH ANY THIRD-PARTY PLATFORM’S POLICIES. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE.

13. Indemnification

You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising from: your use of the Service; Your Content; your use of generated output in advertising or otherwise; or your violation of these Terms or applicable law.

14. Governing law

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law principles, regardless of your location. If you are a consumer in a jurisdiction that grants you mandatory local consumer protections that can’t be waived by contract, this section doesn’t override those protections.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we’ll notify you by email or in-app notice before they take effect. Continued use of the Service after changes take effect constitutes acceptance.
